A federal lawsuit filed by 81-year-old veteran Ramon Najera’s household argues town confirmed “deliberate indifference” to the general public’s security.

The household of Ramon Najera — the 81-year-old veteran killed in a 2023 canine assault that drew nationwide headlines — has sued town of San Antonio, saying it bears duty for the tragedy.

The swimsuit, filed Friday in San Antonio Federal Courtroom, alleges metropolis officers knew the pit bulls that mauled Najera and his spouse Janie have been harmful and had been concerned in earlier assaults. Regardless of that historical past, the submitting argues, town returned the canines to their house owners, setting the stage for Najera’s loss of life.

“The town’s conduct was egregious and constituted a deliberate indifference to the protection and welfare of the general public, particularly Mr. and Mrs. Najera,” alleges the swimsuit, which was filed by Janie Najera on behalf of her kids and property.

Along with town of San Antonio, the swimsuit names Metropolis Lawyer Andy Segovia as a defendant.  

In an announcement, metropolis officers stated the duty for the assault lies with the canine’s house owners, husband and spouse Christian Alexander Moreno and Abilene Schnieder. The pair have since pleaded responsible to the cost of harmful canine assault inflicting loss of life. They now await punishment.

“The duty for the actions of pets lies with the pets’ house owners, and on this case the house owners have been discovered criminally liable,” the assertion stated. “The town has not but been served with the swimsuit. The town will examine the claims and tackle them within the litigation if wanted.”
